The Public Contract Regulations (Scotland)- A Consultation on Changes to the Public Procurement Rules in Scotland

This consultation paper describes, and seeks views on, changes to the public procurement rules in Scotland . These changes largely arise from three new EU Directives concerned with Public Procurement, Concessions and Utilities contracts and must be implemented into new Scottish Regulations by 18 April 2016. The consultation also considers elements of the Procurement Reform (Scotland) Act 2014.
There are some elements where the Scottish Government have a choice about whether to, or how best to, implement further change. These discretionary elements, and the Scottish Government’s plans to implement these, are the main focus of the consultation document. The consultation paper also discusses elements of the Act that have yet to be implemented or further described in Scottish Regulations and Guidance.
Together, the Act and the new Directives will complement the Scottish Model of Procurement through simplifying, standardising and streamlining procedures for both businesses and public bodies. It will place sustainable and socially responsible purchasing at the heart of the process.
